Organizada por docentes do Núcleo de Ensino da Faculdade de Filosofia e Ciências da UNESP, câmpus de Marília, do qual sempre esperamos produções de qualidade ímpar, a coletânea Marx, Gramsci e Vigotski: aproximações reúne, num trabalho de fôlego, artigo de vários autores que, em comum, dialogam com a base teórica marxista, promovendo um encontro bastante oportuno entre questões políticas, filosóficas, pedagógicas e psicológicas.

Este Trabalho discute ações transgressoras didático-pedagógicas ao processo neocolonial no ambiente educacional formal, com o olhar à formação inicial, continuada e a pedagogia no chão da escola, inerentes à superação dos preconceitos, sutis ou não, ao fenótipo negro. Inicialmente rastreou-se, indício das boas práticas didático-pedagógicas, por uma revisão literária, ao se relacionar formação inicial continuada e práticas transgressoras de auto identificação étnico racial no chão da escola, ancorada externamente pelas lutas por uma sociedade e educação antirracistas. Importou sistematizar o processo (...) de silenciamento do fenótipo negro, indutor de subjetividades negras ainda escravizadas, por vezes simbolicamente, nos ambientes educacionais. Além de práticas didático-pedagógicas transgressoras, ao longo do tempo que apresentaram ou têm potencial para atenuação ou superação, segundo a literatura revisada do epistemicídio, conforme a amostragem considerada nos processos de auto identificação inicial e as possíveis identificações mais sólidas no longo prazo detectadas naquelas produções científicas levantadas. As discussões são precedidas pelos alicerces materiais e simbólicos do racismo estrutural, seguidos pelas ações inerentes à formação inicial e continuada, e práticas pedagógicas transgressoras ao neocolonialismo e racismo estrutural. Destaca-se a importância em divulgar os fazeres pedagógicos libertadores para um aquilombamento frente ao neocolonialismo. (shrink)

Esta resenha versa sobre a obra Cidadania e Democracia Deliberativa de Catherine Audard que se refere à uma articulação rawlsiana entre uma teoria da justiça e as teses centrais do seu liberalismo político sobre o pluralismo razoável, democracia deliberativa, cidadania participativa, razão pública, direito dos povos e multiculturalismo.

O artigo pretende analisar e sugerir uma saída para o paradoxo democrático, o dilema moral constitutivo entre a soberania nacional do Estado democrático liberal e o reconhecimento dos direitos humanos dos estrangeiros, apontado por Donatella Di Cesare. Para isso, serão reconstruídos o referido paradoxo, a partir das críticas da autora a Michael Walzer e David Miller, e a solução apontada por ela, que envolve a superação da ordem estadocêntrica e a criação de uma comunidade política que não seja centrada na (...) identidade nacional. Em seguida, serão sucessivamente analisadas as posições de tais autores, mostrando-se que as críticas feitas por Di Cesare não correspondem aos trabalhos desenvolvidos por eles sobre comunidade política e identidade nacional. Por fim, será sugerido que há congruências entre esses três autores que poderiam ajudar na construção conceitual de um conceito de comunidade política capaz de oferecer uma direção inicial de saída do paradoxo democrático. Este ensaio visa refletir sobre as questões de tradução levantadas por Jacques Derrida (1987), questões essas que não chegam a formalizar uma teoria da tradução, mas têm elas o ato de traduzir o original como veredas a ser percorridas por um sujeito endividado, ou seja, o tradutor. No dizer de Derrida, “a tarefa do tradutor indica a lei e a missão outorgada pelo outro a que o tradutor deve responder”. Neste sentido, entendemos aqui a tradução como um ato de diálogo, (...) de negociação, uma vez que a língua, nesta perspectiva, é aquilo que não se deixa possuir. Com isso, os problemas da tradução são - de um lado - o problema da língua, de sua natureza heterogênea, fugidia; e, do outro, do modelo tradicional de tradução que se apoia na concepção de língua como algo homogêneo em que a diversidade, o diferente são vistos como pecado, como transgressão da linguagem (adâmica). A possibilidade de se tolerar um desobediente civil é parte integrante, para muitos autores, do próprio conceito de Estado Democrático de Direito. Porém, a fundamentação e os limites da referida desobediência é matéria controversa, mormente quanto à possibilidade de infringir uma lei com fulcro na objeção de consciência. A discussão central, portanto, permeia a incorporação ou não da objeção de consciência como um fundamento válido para a desobediência civil. Percebe-se, a partir deste debate, que questões morais e legais poderão entrar (...) em conflito e os limites da desobediência dependerão da fundamentação e da justificação tanto filosófica quanto jurídica. Frente à vasta e complexa gama de autores que trabalham o tema, optou-se, no presente ensaio, pela análise crítica e comparativa das teorias de John Rawls e Ronald Dworkin, que divergem exatamente no ponto acima descrito. O primeiro, alicerçado em sua teoria da justiça como equidade, promove o entendimento procedimental da desobediência civil fundamentada em princípios políticos publicamente aceitos, excluindo questões morais. O segundo, por seu turno, entende que em toda regra há um conteúdo moral, passível, portanto, de desobediência com fulcro na objeção de consciência. Tendo em vista a referida dicotomia entre princípios morais e princípios políticos, busca-se verificar se a teoria de Rawls impõe um caráter exageradamente restritivo ou se a compreensão de Dworkin traduz comportamentos estatais excessivamente tolerantes. O presente artigo se justifica pela influência decisiva que ambos os autores têm desempenhado no que se refere à fundamentação da desobediência civil, principalmente no debate em relação às doutrinas liberais de justiça. O PROBLEMA DO LICENCIAMENTO DE GRANDES EMPREENDIMENTOS PRIVADOS EM FACE DO DIREITO URBANÍSTICO: ANÁLISE DE UM CASO EMBLEMÁTICO NA PERIFERIA DA REGIÃO METROPOLITANA DO RIO DE JANEIRO.

Utilizando a abordagem discursivo-desconstrutiva, este trabalho busca refletir sobre a política linguística nacional veiculada nos Parâmetros Curriculares Nacionais de Português (ensino fundamental) cujo discurso se traduz em um método sofisticado de controle e em uma forma eficaz de gerir a mudança (LAWN, 2001, p. 117) para impor uma nova identidade ao professor. Através dessa abordagem, pretende-se apresentar e discutir os resultados analisados, cujo foco recai sobre as representações da (s) identidade (s) e competências construídas para os professores neste discurso, representações (...) sociais da profissão do professor na sociedade contemporânea brasileira, marcada pelos acontecimentos que sucederam ao período ditatorial, portanto, a fase de redemocratização do país e de modernização do Estado frente às exigências da mundialização. Nessa perspectiva, pensamos em e com Foucault (1996, p. 45) quando afirma que “todo sistema de educação é uma maneira política de manter ou de modificar a apropriação dos discursos, com os saberes e os poderes que eles trazem consigo”. Esse estudo apresenta os conceitos de documento e documentação propostos por Paul Otlet (1868-1944) presentes no âmbito da Revista do Serviço Público (RSP). Publicada desde 1937, a RSP contempla artigos nas áreas de Administração e Gestão pública, Políticas públicas e Economia do setor público, sendo considerada um importante veículo de informação no Brasil, contemporâneo ao período de efervescência do pensamento de Otlet. A pesquisa consiste numa Revisão Sistemática de Literatura (RSL) com análise documental da RSP no período entre 1951 e (...) 1975. Como procedimento de seleção dos artigos, utiliza o protocolo de pesquisa RSL elaborado por Valentim (2020). A partir do corpus de análise dos textos recuperados identifica os artigos que apresentam os conceitos de “documento” e “documentação” segundo Otlet, bem como os elementos constitutivos sobre o cenário da documentação no Brasil, na perspectiva da publicação de autores brasileiros na RSP, concluindo que os trabalhos analisados contemplam e ampliam a temática da Documentação com importantes reflexões de Otlet para a Ciência da Informação no Brasil. Background: The new human coronavirus that leads to COVID-19 has spread rapidly around the world and has a high degree of lethality. In more severe cases, patients remain hospitalized for several days under treatment of the health team. Thus, it is important to develop and use technologies with the aim to strengthen conventional therapy by encouraging movement, physical activity, and improving cardiorespiratory fitness for patients. In this sense, therapies for exposure to virtual reality are promising and have been shown to (...) be an adequate and equivalent alternative to conventional exercise programs.Aim: This is a study protocol with the aim of comparing the conventional physical therapy intervention with the use of a non-immersive VR software during COVID-19 hospitalization.Methods: Fifty patients hospitalized with confirmed diagnosis of COVID-19 will be divided in two groups under physiotherapy treatment using conventional or VR intervention: Group A: participants with COVID-19 will start the first day of the protocol with VR tasks in the morning and then in the second period, in the afternoon, will perform the conventional exercises and Group B: participants with COVID-19 will start the first day with conventional exercises in the morning and in the second period, in the afternoon, will perform activity with VR. All participants will be evaluated with different motor and physiologic scales before and after the treatment to measure improvements.Conclusion: Considering the importance of benefits from physical activity during hospitalization, VR software shows promise as a potential mechanism for improving physical activity. Here, Ferreira seeks to rehabilitate Works of Love as one of Kierkegaard's most important works. He shows that Kierkegaard's deliberations on love are highly relevant to some important themes in contemporary ethics, including impartiality, duty, equality, mutuality, reciprocity, self-love, sympathy, and sacrifice. Ferreira also argues that Works of Love bears on issues peculiar to a religious ethic, (...) such as the role of God as "middle term," and the possibility of preserving the aesthetic dimensions of love in a religious ethic of relation. The article analyzes the possibility of reconciling skepticism with moral theories and the idea that moral philosophy is the supreme arbiter of all moral justification. We cannot take universally valid maxims as descriptive rules nor can we fall into an individualistic relativism. H. Putnam seeks to deconstruct Habermas' separation of values and norms, and, in doing so, he shows the need for such a reconciliation.

Este artigo propõe uma discussão sobre jornalismo e subjetividade a partir de uma argumentação que considera que, embora o discurso hegemônico sobre a instituição se construa a partir do ideal da objetividade, de um texto constituído apenas pelos fatos e cujo autor deixa de ser sujeito para assumir a identidade de jornalista, a subjetividade foi sempre constituidora do texto jornalístico. Assim, pensando a partir dos estudos culturais o jornalismo como uma instituição social com formas, valores e funções conformados historicamente, e (...) os sujeitos como indivíduos que se reconhecem a partir de uma ampla rede de relações de poder, de tradições culturais, de representações de identidades, argumentamos que, em um contexto cada vez maior de centralidade dos sujeitos na cultura contemporânea, os discursos sobre si tem sido uma forte tendência também no jornalismo. The increasing use of digital technologies in judicial and arbitration proceedings increases the usage of digital evidence by the parties, which brings the necessity of creating patterns for adjudicators to admit and assess this new type of evidence. This paper generally addresses digital evidence focusing on the second moment in international arbitration proceedings. It also narrows the topic to hacked and leaked evidence and its admissibility in international arbitration. The literature review showed a significant amount of research devoted to the (...) evidence in arbitration. Some considered electronic evidence within one jurisdiction; others focused on certain forms of digital evidence such as electronic signatures. Papers on digital evidence in international arbitration approach arbitration rules for digital evidence but skip admissibility issues. No systemic and complex works research digital evidence in arbitration, explicitly focusing on the admissibility of hacked and leaked digital evidence from a comparative perspective. Also, no research deals with enforcing international arbitration awards relying on illegally obtained digital evidence. In these cases, there could be a possible violation of domestic public policy under the New York Convention terms (art. V, 2, b). That is why the paper aims to offer the concept of digital evidence in international arbitration, including hacked and leaked evidence, criteria of its admissibility and relevance, and design the arbitration guidelines for assessing hacked and leaked evidence. Comparative legal analysis of the international arbitration rules and national procedure law allowed us to compare the regulatory approaches to the definition of digital evidence and its admissibility worldwide. The method of legal modeling allowed designing model guidelines for arbitral tribunals to evaluate the admissibility and relevance of digital evidence, including hacked and leaked evidence. Moreover, the case study method allowed us to analyze jurisprudence and define criteria for admission of hacked and leaked evidence. We conclude that the admissibility of hacked and leaked evidence depends solely on the arbitrator’s broad discretion to assess the evidence. Nevertheless, thorough evidence analysis and a well-reasoned award are always mandatory. (shrink)

The present paper draws a contrast between the notions of τὸ παρ’ ἡμᾶς and τὸ ἐφ’ ἡμῖν to the effect that, according to Chrysippus, each has a different role to play and different requirements to meet, the former being especially tailored to suit the exigencies of praise and blame taken as exhortations, the latter those of desert and justice in praising and blaming as well as honoring and punishing.

This article reports on an EU-funded project conducted in Greece, Portugal, England and Wales. Data were collected from male and female student teachers using surveys, interviews and focus groups. The project investigated their understanding of citizenship and the role of men and women in public and private life. Pateman's concept of a sexual contractwas used to discover how student teachers understood changing relations between men and women. Young professionals in each country had relatively similar representations of the public sphere, which (...) was seen as a distant sphere in which masculine power was unchallenged. The tension between power and femininity was articulated differently by men and women. Cross-national comparisons revealed how women in different European countries struggle over gender relations in family life and in everyday social contexts. Although gender relations are changing, the primary context for female citizenship is still predominantly the family. The sexual contract remains therefore a key theme to be considered in relation to the education of citizens. (shrink)

In this conceptual analysis contribution to the special issue on radical embodied cognition, we discuss how embodied cognition can exist with and without representations. We explore this concept through the lens of judgment and decision making in sports (JDMS). Embodied cognition has featured in many investigations of human behavior, but no single approach has emerged. Indeed, the very definitions of the concepts “embodiment” and “cognition” lack consensus, and consequently the degree of “radicalism” is not universally defined, either. In this paper (...) we address JDMS not from a rigid theoretical perspective, but from two embodied cognition approaches: one that assumes there is mediation between the athlete and the environment through mental representation, and another that assumes direct contact between the athlete and the environment and thus no need for mental representation. Importantly, our aim was not to arrive at a theoretical consensus or set up a competition between approaches, but rather to provide a legitimate scientific discussion about how to explain empirical results in JDMS from contrasting perspectives within embodied cognition. For this, we first outline the definitions and constructs of embodied cognition in JDMS. Second, we detail the theory underlying the mental representation and direct contact approaches. Third, we comment on two published research papers on JDMS, one selected by each of us: (1) Correia et al. (2012) and (2) Pizzera (2012). Fourth, following the interpretation of the empirical findings of these papers, we present a discussion on the commonalities and divergences of these two perspectives and the consequences of using one or the other approach in the study of JDMS. Fueled by ever-growing amounts of (digital) data and advances in artificial intelligence, decision-making in contemporary societies is increasingly delegated to automated processes. Drawing from social science theories and from the emerging body of research about algorithmic appreciation and algorithmic perceptions, the current study explores the extent to which personal characteristics can be linked to perceptions of automated decision-making by AI, and the boundary conditions of these perceptions, namely the extent to which such perceptions differ across media, (public) health, and judicial (...) contexts. Data from a scenario-based survey experiment with a national sample (N = 958) show that people are by and large concerned about risks and have mixed opinions about fairness and usefulness of automated decision-making at a societal level, with general attitudes influenced by individual characteristics. Interestingly, decisions taken automatically by AI were often evaluated on par or even better than human experts for specific decisions. Theoretical and societal implications about these findings are discussed. (shrink)

Palace of the End is a dense triptych of monologues exploring alternative narratives - albeit based in real facts - behind the events and the headlines surrounding the war in Iraq. Borrowing its title from the former royal palace where Saddam Hussein’s torture chamber was located, Thompson’s docudrama is structured as a chain of monologues telling three real-life stories set in the context of the war in Iraq. The play conveys three unconventional interpretations of the realities of war: that of (...) a young American soldier convicted for her misconduct at Abu Ghraib, the prison that stands as one of the most controversial symbols of the American-led Iraq invasion; a British scientist and weapons inspector who denounces what he understands as the false arguments given by his country’s leaders for engaging in a distant war; and an Iraqi mother whose life was shattered firstly by Saddam Hussein’s authoritarian regime, and later by the American first Gulf War. Each story is an enthralling and gut-wrenching reflection of one of the contemporary world’s most studied and controversial conflicts. The play gives voice to three different kinds of war victims, insofar as their political subjectivities and their moral conundrums are concerned. (shrink)

This book examines the significantly similar, yet finally different, thinking of two nineteenth-century existentialist thinkers, Soren Kierkegaard and Friedrich Nietzsche. Its focus is on the different ways each envisioned a joyful acceptance of life - a concern they shared. Each strove to give a place to this acceptance in his picture of life, but their conceptions of it are far apart.

Em Uma teoria da justiça, John Rawls desenvolve os principais conceitos de sua concepção de justiça conhecida como “justiça como equidade”. Nosso foco é o aspecto distributivo desta concepção. O presente artigo procura mostrar características definidoras de uma sociedade organizada conforme as demandas de justiça dos dois princípios de justiça rawlsianos. Para tanto, exploramos os principais aspectos de uma democracia dos cidadãos-proprietários e do socialismo liberal, que são os exemplos de modelos de organização socioeconômica citados por Rawls como compatíveis com (...) sua concepção de justiça. The author goes on to note the ‘therapeutic’ indications already available in the epistemology of Gonseth, which make it possible to reintegrate the idea of objectivity and of truth into knowledge. This is done in three respects. In epistemological methodology, it is shown that Gonseth was aware of the preparatory value of a scientific gnoseology as the fundamental condition for a coherent approach to epistemology. In gnoseology, it is shown that the empirical aspect of Gonseth's schemes, which Piaget found regrettable as being too open to immediate and exterior contact with the object, does after all provide an indication that is invaluable in offsetting the opposing exaggerations of a gnoseology that makes the self‐reference and closedness of the subject one of the justifications for the impossibility of founding knowledge objectively. Finally, it is held that, on a philosophical reading of the sciences, the dialectical relativism of Gonseth recovers the pragmatic value and the value of ‘circumscribed’ objectivity of knowledge, without in so doing giving up the idea of an increase in objectivity. A prevailing view in moral psychology holds that empathy and sympathy play key roles in morality and in prosocial and altruistic actions. Recently, Jesse Prinz (2011a, 2011b) has challenged this view and has argued that empathy does not play a foundational or causal role in morality. He suggests that in fact the presence of empathetic emotions is harmful to morality. Prinz rejects all theories that connect empathy and morality as a constitutional, epistemological, developmental, motivational, or normative necessity. I consider two (...) of Prinz’s theses: the thesis that empathy is not necessary for moral development, and the thesis that empathy should be avoided as a guide for morality. Based on recent research in moral psychology, I argue that empathy plays a crucial role in development of moral agency. I also argue that empathy is desirable as a moral emotion. (shrink)

That is why, at the moment, Brazilians are a people of intermittent qualities and permanent faults.Mário de Andrade, Essai sur la musique brésilienne, 1928This paper sets out to discuss the use and power of music in representing social identities, concentrating on the more specific case of the Brazilian nation, which has made itself a complex and all-embracing socio-political unit in spite of the great diversity and the (...) great inequalities to be found within its borders. It is well known that what appears to be its most uniform feature, the use of a dominant language, is actually quite fragmented, due to the influence of various co-existing systems of production, cultural models and social hierarchies, which change on a daily basis. Although this diversity seems to be underwritten by daily practice and independent of debate and official encouragement, the same cannot be said of the search for national unity. It is obvious in the case of most of the action undertaken with this end in mind, that questions such as exclusion and the imbalance and arbitrariness of power have been eliminated. Besides, certain alert individuals are wary of this insistence on the construction of a nation, since the role of the old national states throughout the world seems to be disintegrating in the face of the proliferation and growing importance of social, economic and cultural relations at a supranational level. It is therefore hardly surprising that the twentieth century is considered to be a milestone in both the rise and fall of efforts to achieve Brazilian national unity. Amongst these efforts, music has played a prominent role, as I shall endeavour to show. (shrink)

A memória é um exercício utilizado desde a Antiguidade Clássica. Trata-se de recordar de fatos que já aconteceram e permaneceram no imaginário individual ou coletivo. Na Grécia antiga, o espaço público era o local escolhido para debater ideias e contar os feitos dos cidadãos. Atualmente, percebe-se que os espaços públicos estão cada vez menos ocupados e que a memória tem sido resumida a “história oficial”. A partir de tais observações, o presente trabalho tem por objetivo tecer reflexões sobre a memória (...) nos espaços públicos, a fim de possibilitar a construção de sujeitos da memória, além de problematizar o exercício da memória em um espaço público específico que é a instituição escolar. O aporte teórico deste estudo está fundamentado em Arendt, Sarlo e Ricoeur. (shrink)

Levinas's ethics of other-centered service has been criticized at the theoretical level for failing to offer a conception of moral agency adequate to ground its imperative and at the practical level for encouraging self-hatred. Levinas's explicit resistance to the incorporation of the phrase "as yourself" in the Judaeo-Christian love command might seem to validate the critics' complaints. The author argues, on the contrary, that Levinas does offer a strong and compelling conception of moral agency and that his ethics, properly understood, (...) does not entail self-abnegation. Levinas's attempt to counter excessive and manipulative self-concern and self-inflation by insisting on the dependent and situational position of the self has been wrongly overinterpreted as an abandonment of the self and its just claims. The author seeks to establish a more balanced understanding by focusing attention on the "ethics of welcome," on Levinas's distinctive conception of passivity, and on the role of "the third" in all human relations. O artigo relaciona os elementos curriculares propostos por Hobbes no capítulo XXX do Leviatã com as leis naturais descritas nos capítulos XIV e XV. Metodologicamente, o trabalho conduz-se em 4 etapas: 1) listar os conteúdos educacionais explicitados no capítulo XXX; 2) buscar potenciais equivalentes de cada um dos conteúdos listados com aspectos das leis naturais presentes nos capítulos XIV e XV; 3) comparar os argumentos e questões teóricas pertinentes a essas equivalências potenciais; 4) destacar possíveis ampliações interpretativas oriundas da análise (...) comparativa realizada. Dada essa escolha metodológica, justifica-se a ausência de outras referências bibliográficas que não o Leviatã. Dentre os achados, sublinha-se que todos elementos curriculares presentes no capítulo XXX puderam ser articulados com, pelo menos, uma lei natural, merecendo destaque a maior ocorrência de vinculações com a terceira lei de natureza. O conto “Meu tio, o Iauretê” (1962), de Guimarães Rosa, problematiza a fronteira entre o homem e o animal, através de uma escrita intensiva, que busca desvelar o animal no humano. Dessa forma, pensar a animalidade em Guima-rães Rosa, significa pensar aquilo que o filósofo francês Gilles Deleuze denominaria “Devir-animal”, conceito presente no texto 1730-Devir- intenso, Devir-animal, Devir-imperceptível..., e que seria da ordem de uma conjugação de um homem com um animal, sendo que nenhum deles se assemelharia ou até mesmo (...) imitaria o outro, ou seja, não seria uma questão de metamorfose, mas de devires, atravessamentos e curto-circuito entre reinos. Nesse sentido, a filosofia de Gilles Deleuze, Jaques Derrida e Georges Bataille servirão como escopo básico para que se reflita sobre a questão do eu e do outro, do homem e do animal, da identidade e da diferença. A problematização dessa questão, através da literatura, visa demonstrar como se dá, na narrativa literária, na linguagem, o questionamento do antropocentrismo, nas palavras de Derrida os “próprios do homem”, o que acarretaria na subsunção da potência da vida, pura, imanente.
